will there be a problem with programming a PDM when it is connected to a bus with already ~ 40% bus load?

no, that should be fine.

It is possible to do as you suggest, that is overload a CAN bus that is amost full, by connecting a UTC to it and programming the unit, but at 40%, you should not have a problem.
